Mission Statement:
It is the goal and responsibility of the Clerk of Court to serve the public in areas including, but not limited to, case management, marriage licenses and child support records. We assist District court judges by providing optimum and efficient management of all District Court Records. Our aspiration is to attain these obligations as efficiently and amiably as possible, as would be expected by the citizens of Lincoln County.
The Lincoln County Clerk of District Court’s Office, as an elected office, is accountable to the public and as such protects public access to the 19th Judicial District Court of Montana and provides the necessary checks and balances for the judicial system. The Clerk of District Court is the official holder of all District Court records for Lincoln County. These records include Adoption, Civil, Criminal, Dependent Neglect, Domestic Relations, Guardianship, Juvenile, Marriage License, Paternity, Probate, Sanity and Statutory Liens cases.
The records in the Clerk of the District Court’s office date back to 1909 and were maintained in books until 1996. Since 1996 these records are maintained through a computer program administered and maintained by the Montana Supreme Court’s Office of the Court Administrator. The public can access these records through a public computer or the manual index book, both of which are located in the Clerk of District Court’s office in Libby. The books and computer included an alphabetic index of names to provide ease in accessing records. Searches, copies and certified copies are provided upon request. Fees for searches, copies and certified copies are charged according to statute.
The Clerk of District Court also serves as Jury Commissioner for Lincoln County. As required by statute, the Clerk shall prepare a jury list for Libby City Court, Eureka City Court, Troy City Court, Justice Court and District Court within the County. The Clerk of District Court maintains the master jury list for Lincoln County.
